Welcome to Simply DSGN. By accessing our website, purchasing services, or working with our company, you agree to the following Terms & Conditions.

1. SERVICES

Simply DSGN provides digital services including, but not limited to:

  • Website Design & Development

  • Website Hosting & Maintenance

  • Branding & Graphic Design

  • Social Media Marketing & Management

  • Content Creation

  • CRM & Automation Setup

  • Search Engine Optimization (SEO)

  • Paid Advertising Management

  • Lead Generation Systems

  • Consulting & Strategy Services

Service scope will vary depending on the selected package, agreement, or proposal.

2. PAYMENTS

All invoices must be paid according to the agreed payment terms.

Services may require:

  • upfront deposits

  • recurring monthly payments

  • milestone payments

  • subscription billing

Failure to complete payment may result in:

  • delayed work

  • paused services

  • suspension of websites or campaigns

  • termination of services

All payments are non-refundable unless otherwise stated in writing.

3. MONTHLY SERVICES & SUBSCRIPTIONS

Monthly service plans may include:

  • website hosting

  • maintenance

  • support

  • CRM access

  • automation systems

  • marketing services

Subscription-based services remain active only while payments are current.

Cancellation of subscription services may result in:

  • website suspension

  • removal of hosted content

  • revoked access to platforms or systems

  • termination of automations and integrations

Minimum service terms may apply depending on the selected package.

4. CLIENT RESPONSIBILITIES

Clients agree to provide all necessary:

  • business information

  • logos

  • images

  • written content

  • access credentials

  • approvals

  • requested feedback

Delays in communication or approvals may delay project timelines.

Clients are responsible for ensuring all submitted materials are legally owned or licensed.

5. REVISIONS & SCOPE

Projects include only the revisions or deliverables outlined in the selected service agreement.

Additional requests outside the original project scope may require:

  • additional billing

  • timeline adjustments

  • separate agreements

Simply DSGN reserves the right to determine whether requested work falls outside the original scope.

6. HOSTING & THIRD-PARTY PLATFORMS

Certain services may rely on third-party platforms including, but not limited to:

  • Squarespace

  • GoHighLevel

  • Stripe

  • Google

  • Meta/Facebook

  • Instagram

  • TikTok

  • Domain Registrars

  • CRM Systems

  • Email Providers

Simply DSGN is not responsible for outages, limitations, policy changes, or interruptions caused by third-party platforms.

Clients are responsible for maintaining active accounts, domain renewals, and applicable third-party fees unless otherwise agreed.

7. MARKETING & ADVERTISING DISCLAIMER

Simply DSGN does not guarantee:

  • specific rankings

  • specific lead volume

  • ad performance

  • revenue increases

  • business growth

  • conversion rates

Marketing results depend on multiple external factors outside of our control.

8. INTELLECTUAL PROPERTY

Unless otherwise agreed in writing:

  • final paid deliverables belong to the client

  • unused concepts, drafts, templates, systems, and internal frameworks remain the property of Simply DSGN

Subscription-based websites and systems may remain hosted and managed by Simply DSGN while the subscription remains active.

9. PORTFOLIO RIGHTS

Simply DSGN reserves the right to display completed work, designs, websites, branding, marketing materials, and related deliverables in portfolios, social media, presentations, and promotional materials unless otherwise agreed in writing.

10. LIMITATION OF LIABILITY

Simply DSGN shall not be liable for:

  • indirect damages

  • lost profits

  • business interruption

  • data loss

  • platform outages

  • advertising platform issues

  • third-party failures

Total liability shall not exceed the total amount paid by the client within the previous three months of service.

11. TERMINATION

Simply DSGN reserves the right to terminate services for:

  • non-payment

  • abusive behavior

  • illegal activity

  • violation of these terms

Clients may terminate services according to the terms outlined in their service agreement.

Outstanding balances remain due after termination.

12. CHANGES TO TERMS

Simply DSGN may update these Terms & Conditions at any time without prior notice.

Continued use of our services constitutes acceptance of updated terms.
